What documents do I need to create a contract?
You'll need to keep to hand:
  • The cadastral reference of the property.
  • The account number where you will receive your rent payments.
  • Photo of your ID document.
  • The personal identification details, email and telephone number of the tenants.
  • It is advisable to have a photo of the tenant's identity card.
How does the contract protect you against defaulting tenants?
The contract includes a privacy notice informing the tenant that the landlord can ask for them to be included in the defaulting tenants database in case of non-payment. This protects other landlords by preventing them from renting out their properties to defaulting tenants.
What is the Istat rent update?
This is a rent update that can take place every year according to the inflation rate published by Istat (the national statistics institute in Italy). This figure, calculated on the basis of the cost of living, must be added to the established monthly rent.
Is it possible to exercise the "Cedolare Secca" tax regime option with this contract?
Pursuant to and for the purposes of Article 3 of Legislative Decree No. 23 of 14 March 2011, the lessor may exercise the option to make use of the "Cedolare Secca" tax regime. In this case, the lessor must give prior notice to the lessee of his intention to waive without exception, during the period corresponding to the duration of the option, the right to request the updating of the rent for any reason, including the variation ascertained by ISTAT of the national index of household consumer prices that occurred in the previous year.
