There are many different types of rental contract in Italy, including contracts that are aimed specifically at students. Student leases are popular rental formulas for university students away from home, both Italian and foreign students, and this type of contract is characterised by the temporary duration of the lease. How do student leases work in Italy?

University or student leases are particular types of contract for transitory use in which a landlord makes a property available to one or more university students against payment of a sum of money agreed by the parties or by national agreement. 

Student rental contracts in Italy: conditions

Tenancy agreements for university or Erasmus students studying in Italy are a special type of rental agreement for temporary use that deviates from the normal long-term rental conditions laid down by the law. Two requirements are necessary to take advantage of a student rental contract in Italy:

  • the student must reside in a different municipality from the one in which the rental property is located (details to be included in the contract);
  • this property must be located in the same municipality as the university in which the student is enrolled, or in a neighbouring municipality.

Rental contracts for students must be drawn up using the model prepared by the Ministry of Transport and Infrastructure (from the Ministerial Decree of 30th December 2002, Annex F). A student rental agreement in Italy must necessarily contain:

  • the personal details of both parties (student and landlord)
  • a description and the location of the property, specifying that it is located in a municipality other than the municipality of residence of the student
  • a reference to the university attended by the tenant
  • the duration of the contract
  • the amount of the rent and how payment will be made
  • a clause relating to the fact that the tenant has received documentation on the building's energy performance so as not to incur administrative sanctions.

How does the student contract work?

The stipulation of a student rental contract must contain the duration of the contract itself, which, by law, must range from a minimum of 6 to a maximum of 36 months. It can also be countersigned by the student's parents who can act as guarantors to provide greater guarantees to the landlord.

Tax benefits for landlords in Italy

This type of rental contract also brings advantages for landlords and property owners in terms of taxation. This type of contract allows access to tax benefits in Italy and the possibility of a 10% flat rate.

Moreover, the advantages for the owner consist in:

  • a 30% reduction on taxable income
  • a 75% reduction on the IMU property tax rate.

For students, on the other hand, this type of contract is also advantageous because the rent is set by trade unions and universities. In addition, it is possible to claim a deduction of the rent paid via a tax return.

How do you register a student rental contract in Italy?

Once the rental contract for university students has been drawn up, if the duration of the rental contract exceeds 30 days, it must be registered with the Inland Revenue within 30 days of the date of stipulation. To proceed with registration, two copies of the contract are required, as well as the payment of a registration tax and a revenue stamp.
